Our main policy is to try to make our customers happy and we will do everything we can, within reason, to make this happen. But everything below are the rules at the "end of the day".
Terms and Conditions of Sale.
Welcome to GroovyGameGear.Com. Please note that use of our "online store" constitutes your agreement to follow and be bound by the rules and terms set forth by this and other store policies of GroovyGameGear.Com.
Your placement of an order indicates your acceptance of these terms and conditions. If you do not agree to abide by the terms, please do not use this "online store". IDVT Inc. reserves the right to make changes to this site and these terms and conditions at any time.
Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to
typographical error or error in pricing or product information received from our suppliers, GroovyGameGear.Com
shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.
GroovyGameGear.Com shall have the right to refuse or cancel any such orders whether or not the order
has been confirmed and your credit card charged. If your credit card has already been charged for the
purchase and your order is canceled, GroovyGameGear.Com shall immediately issue a credit to your credit
card account in the amount of the charge.
Order Acceptance Policy
Your receipt
of an electronic or other form of order confirmation does not signify our acceptance of your order, nor
does it constitute confirmation of our offer to sell. GroovyGameGear.Com reserves the right at any time
after receipt of your order to accept or decline your order for any reason. If insufficient quantities
of any item are not available to fill your order, GroovyGameGear.Com will notify you that this is the
case and offer you the option of cancelling.
Terms of payment are within GroovyGameGear.Com's
sole discretion, and unless otherwise agreed to by GroovyGameGear.Com, payment must be received by GroovyGameGear.Com
prior to GroovyGameGear.Com's acceptance of an order. Payment for the products and services and support
may currently be made by credit card or some other prearranged payment method. We may require additional
verifications or information before accepting any order. Due to the high instances of fraud on Internet
orders, shipments may, without exception, only be delivered to verifiable billing addresses for the credit
card used to place the order.
GroovyGameGear.Com continually upgrades and revises its products
and service offerings to provide GroovyGameGear.Com customers with new products and service offerings.
GroovyGameGear.Com may revise and discontinue products at any time without prior notice to customers.
GroovyGameGear.Com will ship products that have the functionality and performance of the products ordered,
but changes between what is shipped and what is described in a specification sheet or catalog are possible.
In regards to IDVT Inc./GroovyGameGear.Com products, this would usually only be a variation in style
or appearance of components or other inconsequential items. At no time will major subtitutions be made
without the permission of the customer.
Shipping Charges; Taxes.
Separate charges
for shipping and handling will be shown on the emailed invoice. GroovyGameGear.Com shall automatically
charge and withhold the applicable sales tax for orders to be delivered to addresses within New York.
Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any
other state.
Service and Support
GroovyGameGear.Com will provide on-line
support for all products manufactured by IDVT Inc./GroovyGameGear.Com
All requests for technical
service and support of items not manufactured by IDVT Inc./GroovyGameGear.Com should be made directly
to the manufacturer in accordance with their terms and conditions.
Lead Hazard Notice
Some products available for purchase on this site, specifically those devices with exposed circuitry, may contain lead, which is a hazardous substance. These devices are intended for use by skilled individuals and are not intended for use by individuals unable or unwilling to use proper precautions when handing them. These devices are not toys and must be kept out of reach of children at all times.
After handling any exposed circuitry, one must always wash their hands thoroughly before handling food items or bringing hands into contact with the mouth.
IDVT Inc. / GroovyGameGear accepts no responsibility for any personal injury as a result of improper handling or precaution when using or storing such devices.
Jurisdiction and Venue
You agree that any legal action brought against IDVT Inc. shall be governed by the laws of
the State of New York without regard to its conflict of law principles. You agree that the sole jurisdiction
and venue for any litigation arising from your use of or orders made on the GroovyGameGear.Com sites
shall be an appropriate federal or state court located in Tompkins County, New York.
Disclaimer
and Limitation of Liability as to Products Sold
All of GroovyGameGear.Com products are guaranteed
against defects for 30 days from the date of the invoice. Except as expressly stated herein, ALL PRODUCT
IS SOLD ON AN "AS IS" BASIS. GroovyGameGear.Com makes no representations or warranties, either express
or implied, of any kind with respect to products sold on the GroovyGameGear.Com. GroovyGameGear.Com expressly
disclaims all warranties, express or implied, of any kind with respect to products sold on this site,
including but not limited to, merchantability and fitness for a particular purpose. product made by components
either new or refurbished to be functionally equivalent to new. IDVT Inc./GROOVYGAMEGEAR.COM SHALL HAVE
NO LIABILITY FOR ANY INDIRECT OR SPECULATIVE DAMAGES INCLUDING, WITHOUT LIMITING THE FOREGOING, CONSEQUENTIAL,
INCIDENTAL AND SPECIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE PRODUCTS SOLD, WHETHER
ARISING OUT OF CONTRACT, NEGLIGENCE, TORT, OR UNDER ANY WARRANTY, IRRESPECTIVE OF WHETHER GROOVYGAMEGEAR.COM
HAS ADVANCE NOTICE OF THE POSSIBILITY OF ANY SUCH DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF USE,
